Terms and Conditions for Commissioned Artwork

The Artist: Marion Dutton


The Client: Any individual who commissions a painting via this website or directly from the Artist.
Commissioned Artwork: Any custom artwork commissioned from the Artist.

Please read these terms and conditions carefully before placing a commission with Marion Dutton (hereafter referred to as “the Artist”). By making any payment towards a commission, the Client acknowledges that they have read, understood, and agreed to all terms outlined below.

1. Acceptance of Terms

The Client is not required to provide a physical or digital signature. By commissioning artwork and/or making payment, the Client agrees to be bound by these Terms and Conditions.

2. Payment Terms

The Client may choose to pay in full or reserve a place in the Artist’s schedule with a deposit of 25% of the total commission cost. The remaining balance is due in full upon approval of the final image of the completed artwork. No artwork will be shipped until the full payment has been received.

4. Refunds

Refunds may be granted under the following circumstances:

  • If the Artist needs to cancel the commission for any reason.

  • If the Client is not satisfied with the final artwork, a full refund will be issued, and the Artist will retain all rights to the artwork, including the right to resell.

  • If the artwork is damaged during shipping (see Postal Damage section).

5. Returns and Exchanges

Due to the bespoke nature of commissioned artwork, returns and exchanges are not accepted.

6. Commission Refusal

The Artist reserves the right to refuse any commission. In such cases, any payments already made will be refunded in full.

7. Termination of a Commission

The Artist may terminate a commission at any time if necessary. All payments made up to that point will be refunded in full, whether or not any work has commenced.

8. Adjustments

Adjustments may be made upon completion and are classified as Minor or Major:

  • Minor Adjustments: Small changes based on original reference photos or missed details. These are provided free of charge.

  • Major Adjustments: Requests that deviate from the original brief or reference images. These may incur an additional fee and are carried out at the Artist’s discretion. All major changes must be agreed upon in writing before any further work begins.

Clients are encouraged to share all specific requests at the time of booking to avoid extra charges later.

9. Pricing

Commission prices are subject to change at any time.

  • If a Client has already booked a commission and is paying in instalments, any price changes will not affect the remaining balance.

  • If a discount or sale was active at the time of booking, it will apply to all payments made for that commission, regardless of whether the sale has since ended.

10. Estimated Completion Time

The Artist will provide an estimated timeframe for completion at the time of booking. This is an estimate, not a guarantee. Delays may occur, and the Artist agrees to communicate any changes promptly with the Client.

11. Shipping

UK Shipping:

  • Paintings up to 20"x24" are shipped via Royal Mail Tracked.

  • Larger pieces may be shipped via UPS, or an alternative courier.

  • A flat shipping fee of £15 applies to works 16x12" or smaller.

  • The Client may request a specific courier but will be responsible for any additional costs.

The Artist is not responsible for delays caused by shipping carriers.

International Shipping:

  • International shipping is available on request.

  • The Client is responsible for all costs, including postage, duties, taxes, and any handling fees.

  • Full shipping fees must be paid before the artwork is dispatched.

12. Postal Damage and Loss

The Artist takes great care to ensure each painting is securely packaged.
All parcels are insured through the chosen courier.

If your artwork arrives damaged:

  • Contact the Artist within 48 hours of delivery.

  • Provide photographs of the damaged packaging and artwork.

  • The Artist will file a claim with the courier and, if the claim is approved, issue a full refund to the Client.

As of 15th April 2025, no damage has occurred in transit.

13. Use of Artwork

Copyright remains with the Artist at all times.

  • The Artist may use images of the commissioned work for marketing, advertising, portfolio display, or on social media.

  • The Client may display the artwork in their home and share photos on social media with credit to the Artist.

  • The Client may not profit from the artwork, nor reproduce it in any form (prints, merchandise, digital copies, etc.) without written permission from the Artist.

14. Digital Images and Colour Accuracy

Digital images sent via email or displayed on the Artist’s website may not fully represent the artwork due to screen differences and lighting conditions. Every effort is made to ensure photographs are as accurate as possible.

15. Amendments to These Terms

The Artist reserves the right to amend these Terms and Conditions at any time. The most recent version will always be available on the website, with the revision date listed below.

AUTHENTICITY AND PRESENTATION

Each Commissioned Artwork will be accompanied by a signed Certificate of Authenticity, beautifully presented in a protective folder for you to keep. A second certificate will be affixed to the back of the painting, along with a stamped authentication mark. These elements serve as assurance of the genuine nature and originality of your artwork, providing both provenance and peace of mind.
